SMS/Text Messaging Consent Policy

1. Overview

This SMS/Text Messaging Consent Policy describes the text messaging program operated by BioX Unlimited LLC, doing business as Function Bone Health and operating Strength Lab Plus wellness studios ("Company," "we," "us," or "our"). This policy supplements our Terms of Service and Privacy Policy and specifically governs the collection and use of mobile phone numbers and SMS/MMS consent data.

2. Program Description

Program Name: Function Bone Health Text Messaging Program

Program Operator: BioX Unlimited LLC d/b/a Function Bone Health

Short Description: Recurring automated and non-automated SMS/MMS messages related to bone health screening appointments, wellness education, service updates, and promotional offers.

3. How You Opt In

You may opt in to receive text messages through any of the following methods:

3.1 Online Opt-In (Website)

By entering your mobile phone number and checking the SMS consent checkbox on our booking form at functionbonehealth.com/book
By entering your mobile phone number and checking the SMS consent checkbox during account registration at functionbonehealth.com
By entering your mobile phone number and checking the SMS consent checkbox on our contact form at functionbonehealth.com/contact

Opt-in checkbox language:

Message and data rates may apply. Consent is not a condition of purchase. Reply STOP to opt out, HELP for help. See our Terms of Service and Privacy Policy.

3.2 In-Person Opt-In (Paper Form / Verbal)

By providing your mobile phone number and signing the SMS consent section of the Client Service Agreement at any Function Bone Health or Strength Lab Plus location
By verbally confirming consent to receive text messages when providing your phone number to our staff at a location (staff will document the verbal consent with date, time, and staff member name)

3.3 Keyword Opt-In (Text-to-Join)

By texting the keyword BONE or JOIN to our designated business number
You will receive a confirmation message:

"Function Bone Health: You've opted in to receive text messages. Msg frequency varies (up to 10/month). Msg & data rates may apply. Reply STOP to opt out, HELP for help. Terms: functionbonehealth.com/legal/terms"

3.4 Opt-In Confirmation

Regardless of the opt-in method, you will receive a single confirmation text message upon enrollment:

"Function Bone Health: Welcome! You're now signed up for text updates. Msg frequency varies. Msg & data rates may apply. Reply STOP to cancel, HELP for help."

4. Types of Messages You May Receive

4.1 Transactional Messages

Appointment confirmation
Appointment reminders (typically 24 hours and 1 hour before)
Rescheduling and cancellation confirmations
Service follow-up messages
Account verification codes
Payment and receipt confirmations

4.2 Educational Messages

Bone health screening reminders
Wellness tips and educational information
New content alerts (articles, webinars, courses)
Seasonal health awareness messages

4.3 Promotional Messages (Separate Consent)

Special offers and discounts
New service announcements
Referral program updates
Event invitations

Note: Promotional messages require separate, explicit opt-in consent beyond the base transactional/educational messaging consent.

5. Message Frequency and Costs

Frequency: Message frequency varies. You may receive up to 10 messages per month depending on appointment activity and communication preferences
Data Rates: Message and data rates may apply depending on your mobile carrier and plan. Contact your carrier for details
No Charge From Us: We do not charge for text messages we send. Standard carrier messaging rates apply

6. How to Opt Out

You may opt out of text messages at any time using any of the following methods:

6.1 Text STOP

Reply STOP (or STOPALL, UNSUBSCRIBE, CANCEL, END, QUIT) to any text message from us. You will receive a single confirmation message:

"Function Bone Health: You've been unsubscribed and will no longer receive text messages. Reply HELP for help or contact support@functionbonehealth.com."

6.2 Email

Send an email to support@functionbonehealth.com with the subject line "SMS Opt-Out" and include your phone number.

6.3 Phone

Call (239) 544-4114 and request removal from the text messaging program.

6.4 In Person

Request opt-out at any Function Bone Health or Strength Lab Plus location.

After opting out:

No further text messages will be sent (except the single confirmation)
You may still receive communications via email or phone (separate opt-out required)
You may re-opt in at any time by following the opt-in methods in Section 3

8. Privacy — Phone Number and Consent Data

8.1 We Do Not Sell Your Phone Number

We do not sell, rent, lease, or share your mobile phone number, SMS opt-in status, or SMS consent data with any third party or affiliate for their marketing or promotional purposes.

8.2 Limited Sharing for Message Delivery Only

Your mobile phone number and opt-in consent data are shared only with our messaging service provider (currently GoHighLevel/LeadConnector operating via Twilio) solely for the purpose of delivering text messages on our behalf. This service provider is contractually prohibited from using your phone number for any other purpose.

8.3 No Third-Party Marketing Access

No third party, affiliate, partner, or external entity has access to your phone number or consent data for marketing purposes. This includes referral partners, provider network participants, supplement suppliers, and any other entity.

8.4 Data Retention

SMS consent records (phone number, opt-in method, date/time, opt-out records) are retained for 5 years from the date of last activity for compliance and audit purposes. Message content logs are retained for 90 days for delivery troubleshooting and then permanently deleted.

9. Consent Is Not a Condition of Purchase

Your consent to receive text messages is entirely voluntary and is NOT a condition of purchasing any service, product, or package from Function Bone Health. You may use all of our services without opting in to text messages.

10. Supported Carriers

Our text messaging program supports all major U.S. mobile carriers, including but not limited to:

AT&T, Verizon Wireless, T-Mobile, Sprint, U.S. Cellular, Boost Mobile, MetroPCS, Virgin Mobile, Cricket Wireless, and their respective affiliates and MVNOs.

Note: Carrier delivery is not guaranteed. Carriers are not liable for delayed or undelivered messages. Pre-paid phone plans may not support all messaging features.

11. Compliance

This SMS/Text Messaging Consent Policy and our text messaging practices comply with:

Telephone Consumer Protection Act (TCPA) — 47 U.S.C. § 227
CAN-SPAM Act — 15 U.S.C. §§ 7701–7713 (as applicable to commercial electronic messages)
CTIA Messaging Principles and Best Practices
The Campaign Registry (TCR) — 10DLC registration requirements
Mobile Marketing Association (MMA) Guidelines
FCC regulations governing automated and pre-recorded messages
State-specific consumer protection laws as applicable

12. Changes to This Policy

We may update this SMS/Text Messaging Consent Policy from time to time. Material changes will be communicated by posting the revised policy on our Website. Significant changes to the messaging program will also be communicated via text message to opted-in users.
